Terms of Service

1. Accepting these terms

These Terms of Service (the "Terms") are a binding agreement between you and KUBORA (the "Service", "we", "us"). By downloading, installing, signing in to, or otherwise using KUBORA, you agree to these Terms and to our Privacy Policy.

If you are under the legal age of majority where you live, you must have a parent or legal guardian's permission. If you're using KUBORA on behalf of a company or other organization, you confirm you have authority to bind them to these Terms.

2. Accounts

You may browse and use local features of KUBORA without an account. Some features — cloud sync, publishing, multiplayer, the marketplace — require an account. You are responsible for keeping your credentials safe and for all activity on your account. Tell us at security@kubora.net if you suspect unauthorized access.

You must provide accurate information at signup and keep it up to date. One person, one account — don't share login details with others.

3. License to use KUBORA

Subject to these Terms, we grant you a personal, non-exclusive, non-transferable, revocable license to install and use the KUBORA desktop client, the KUB language runtime and the cloud services for your own use — including to create, publish and monetize worlds.

You may not: reverse-engineer, decompile, or disassemble the compiled client beyond what law allows; sublicense or resell access; remove or tamper with any proprietary notices; use our trademarks without written permission.

4. Your content

You own your content. Worlds, scripts, 3D models, textures, audio, and everything else you upload or create inside KUBORA ("Your Content") remains yours.

To run the Service we need a limited license. By uploading or publishing Your Content to KUBORA, you grant us a worldwide, royalty-free, non-exclusive license to host, store, reproduce, transmit, adapt (purely for formats and display), and display Your Content solely for the purpose of operating and improving KUBORA and delivering your content to the people you chose to share it with. This license ends when you delete the content, except for reasonable backup copies that are purged within 90 days.

You represent that you have the right to post Your Content, that it doesn't infringe on anyone's intellectual property or privacy, and that it complies with section 5.

5. Acceptable use

Don't do or post things that:

• Violate any law or regulation;
• Infringe someone else's copyright, trademark, patent, trade secret, privacy or publicity rights;
• Are sexually explicit involving minors, or exploit minors in any way;
• Are hateful, threatening, or incite violence against any person or group;
• Constitute doxxing, stalking, or other real-world harassment;
• Are malware, phishing, spam, or otherwise designed to harm other users;
• Attempt to circumvent rate limits, quotas, or authentication systems;
• Scrape or crawl the Service beyond what our robots.txt allows;
• Use the Service to train AI models on Your Content or other users' content without explicit permission.

We may remove content, suspend accounts, or terminate access for violations of this section, with or without notice depending on severity.

6. Payments & KUBITS

The KUBORA client is free. There is no subscription and no paid tier for build or publish tools. The only paid product is KUBITS — in-world currency sold as one-time bundles. Bundle sizes and prices are on our Pricing page.

KUBITS are virtual currency, not money. They can only be spent inside KUBORA. They are not transferable between accounts, cannot be converted back to cash by you, have no market price, and are not securities, investments, tokens, or legal tender. KUBITS do not expire as long as your account stays active. We may adjust the exchange rate (currently 100 K = $1.00 USD) on future purchases with 30 days' notice; any KUBITS you already own are unaffected by later rate changes.

Payments are processed by our third-party payment provider acting as the merchant of record; they collect and remit applicable taxes (VAT, GST, sales tax). We do not auto-renew anything and do not store your card unless you explicitly ask us to at checkout.

KUBITS bundles are one-time and final once the KUBITS have been spent. An unspent bundle is refundable under the conditions described in section 7 and in the Refund Policy.

7. Refunds

A KUBITS bundle is refundable within 14 days of purchase if none of its KUBITS have been spent. We also refund clear billing errors (duplicate charges, wrong amount) at any time. The full Refund Policy applies and is incorporated into these Terms by reference.

8. Creator program

If you choose to sell access, cosmetics, game-passes or content from your published worlds, the Creator Program applies:

• Eligibility. Free to join. You need a KUBORA account in good standing and a verified payout identity (name, address, tax form).
• Pricing is in KUBITS. You set the KUBITS price on each item. Players pay in KUBITS; your balance is credited in USD at the fixed rate of 100 KUBITS = $1.00.
• 90 % revenue share. KUBORA pays out 90 % of the USD value of every KUBIT spent in your world. The remaining 10 % covers payment processing, platform fraud controls, and operations.
• Payout cadence. Monthly on the 15th, minimum $10 USD. Payouts are made in fiat USD via bank transfer (SEPA, ACH, SWIFT) or PayPal, never as KUBITS credit.
• Taxes. You are an independent creator responsible for your own income taxes. We may be required to collect a W-9 / W-8 or equivalent for tax reporting and will provide annual payout summaries.
• Conduct. You must comply with our content rules and with applicable consumer laws — clear pricing, no deceptive practices, honoring the item a player bought.
• Chargebacks & refunds. End-user refunds (platform-granted or merchant-granted) and chargebacks are deducted from your next payout.
• Enforcement. We can remove monetization privileges, freeze unreleased balances, or terminate the account for fraud, repeated disputes, or TOS violations.

9. Termination

You can stop using KUBORA any time by uninstalling the client and deleting your account from Settings → Account. We can suspend or terminate access for serious or repeated violations of these Terms. If we terminate for cause, we may refuse to refund the unused portion of any paid plan.

10. Warranty disclaimer

The Service is provided "as is" and "as available". To the maximum extent permitted by law, we disclaim all warranties, express or implied, including fitness for a particular purpose, non-infringement and quiet enjoyment. We don't warrant that the Service will be uninterrupted, error-free, or that stored content cannot be lost.

11. Limitation of liability

To the maximum extent permitted by law, our aggregate liability to you for all claims arising out of or relating to the Service will not exceed the greater of (a) the amount you paid us in the 12 months before the claim, or (b) USD 50. We are not liable for indirect, incidental, special, consequential, punitive or exemplary damages, or for lost profits, revenues, or data.

Some jurisdictions don't allow certain limitations — in those places, our liability is limited to the minimum allowed by law.

12. Changes

We may update these Terms. Material changes take effect 30 days after we notify you by email or in the product. Your continued use after the effective date means you accept the update. If you don't accept it, stop using the Service; if you're on a paid plan we'll pro-rate the unused portion.

13. Governing law & disputes

These Terms are governed by the laws of Ukraine, without regard to its conflict-of-laws rules. Disputes that can't be resolved through good-faith correspondence will be submitted to the competent courts at our registered address. Nothing in this section removes mandatory consumer-protection rights you have under the laws of your country of residence.
